• "Deliverables" refers to the final design files and materials provided to the Client
• "Project" refers to the specific design work commissioned by the Client

3. Services Description

FesWeb provides professional graphic design services including but not limited to:

• Logo design and brand identity
• Marketing materials and collateral
• Digital graphics and illustrations
• Website and app UI assets
• Animation and motion graphics
• Packaging design
• Print design services

Specific services and deliverables will be outlined in individual project agreements or service packages.

4. Service Packages and Pricing

4.1 Package Options

We offer three main service packages:

• Starter ($149/month): Basic logo design and social media graphics
• Pro ($399/month): Complete brand identity and marketing materials
• Elite ($799/month): Comprehensive design support with dedicated management

4.2 Custom Projects

Custom pricing is available for projects outside our standard packages. Quotes will be provided based on project scope and requirements.

4.3 Payment Terms

• Payment is due upon project initiation
• We accept major credit cards and PayPal
• All prices are in USD and exclude applicable taxes
• Prices are subject to change with 30 days notice

5. Project Process and Timeline

5.1 Project Initiation

Projects begin upon:

• Receipt of signed agreement or purchase confirmation
• Payment of required fees
• Completion of project brief and requirements gathering

5.2 Design Process

1. Discovery: Understanding your requirements and goals
2. Concept Development: Creating initial design concepts
3. Review and Feedback: Client review and feedback incorporation
4. Refinement: Making revisions based on feedback
5. Final Delivery: Providing final files and assets

5.3 Timelines

• Starter Package: 3-5 business days
• Pro Package: 5-7 business days
• Elite Package: 7-10 business days
• Custom projects: Timeline specified in project agreement

6. Revisions and Modifications

6.1 Included Revisions

• Starter Package: Up to 2 revision rounds
• Pro Package: Unlimited revisions
• Elite Package: Unlimited revisions

6.2 Additional Revisions

Additional revisions beyond the included amount for Starter packages are available at $25 per revision round.

6.3 Major Changes

Significant changes to project scope or direction may require additional fees and timeline adjustments.

7. Client Responsibilities

Clients are responsible for:

• Providing clear project requirements and objectives
• Supplying necessary content, images, and materials
• Providing timely feedback during the design process
• Ensuring all provided content is legally compliant and properly licensed
• Making payments according to agreed terms
• Final approval of deliverables before project completion

8. Intellectual Property and Ownership

8.1 Final Deliverables

Upon full payment, the Client owns the rights to the final approved deliverables for their intended commercial use.

8.2 Work-in-Progress

FesWeb retains ownership of all preliminary designs, concepts, and work-in-progress materials not included in the final deliverables.

8.3 Portfolio Rights

FesWeb reserves the right to display completed work in our portfolio, marketing materials, and case studies unless otherwise agreed in writing.

8.4 Third-Party Materials

Clients are responsible for ensuring proper licensing of any third-party materials (fonts, images, etc.) used in their projects.

9. Cancellation and Refunds

9.1 Client Cancellation

Clients may cancel projects with the following conditions:

• Before design work begins: Full refund minus payment processing fees
• After initial concepts are delivered: 50% refund
• After final approval: No refund

9.2 Company Cancellation

FesWeb reserves the right to cancel projects and provide full refunds in cases of:

• Inability to meet client requirements
• Client non-compliance with these Terms
• Illegal or unethical project requests

10. Limitation of Liability

FesWeb's liability is limited to the amount paid for the specific project. We are not liable for:

• Indirect, incidental, or consequential damages
• Loss of profits or business opportunities
• Third-party claims related to the use of deliverables
• Technical issues beyond our reasonable control

11. Confidentiality

FesWeb agrees to:

• Keep all client information confidential
• Not disclose proprietary business information
• Use client information solely for project completion
• Implement reasonable security measures to protect client data

12. Force Majeure

FesWeb is not liable for delays or failures in performance due to circumstances beyond our reasonable control, including but not limited to:

• Natural disasters
• Government actions or regulations
• Internet or technology failures
• Health emergencies or pandemics
• Labor disputes

13. Dispute Resolution

13.1 Negotiation

Any disputes will first be addressed through good faith negotiation between the parties.

13.2 Mediation

If negotiation fails, disputes will be resolved through mediation before pursuing legal action.

13.3 Governing Law

These Terms are governed by the laws of Kentucky, United States, without regard to conflict of law principles.

14. Website Use

14.1 Acceptable Use

You may use our website for lawful purposes only. Prohibited activities include:
